Terms of Service

These terms are a contract between you (and any organization you represent) and Harpoon Performance ("Harpoon", "we", "us") governing your use of our website, apps, and APIs (the "Service"). By creating an account or using the Service you agree to them. If you don't agree, don't use the Service.
1. The service#
Harpoon analyzes HTTP Archive (HAR) captures to find performance problems, explains them with AI-generated narrative, and can capture pages, monitor them on a schedule, and open suggested fix pull requests against connected repositories. Findings are advisory — they are engineering guidance, not guarantees of any outcome.
2. Accounts & organizations#
- You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account.
- Data is scoped to an organization (workspace). An organization owner controls its members, billing, and deletion.
- You must be old enough to form a binding contract in your jurisdiction to use the Service.
3. Acceptable use#
You agree not to:
- Capture, monitor, or analyze sites or accounts you are not authorized to test.
- Upload data you have no right to process, or that violates a third party’s privacy or other rights.
- Attempt to break tenant isolation, probe, overload, or reverse-engineer the Service, or use it to build a competing product.
- Use the Service for anything unlawful or to store others’ credentials without authorization.
Automated capture visits third-party pages at your direction; you are responsible for having permission to capture them.
4. Plans, billing & trials#
- Paid plans start with a 14-day free trial that collects a card up front and converts to a paid subscription automatically unless you cancel first.
- Subscriptions are billed monthly or annually through our payment processor, Stripe. You can change or cancel anytime from the billing portal; access continues until the end of the paid period.
- Fees are non-refundable except where required by law; if something goes wrong, contact us and we’ll try to make it right.
- We may change prices with reasonable notice; changes take effect at your next renewal.
5. Your content#
You keep all rights to the HAR files, captures, and other data you upload ("Your Content"). You grant us a limited license to host and process Your Content solely to operate and improve the Service for you. You confirm you have the right to upload Your Content and that we may process it as described in our Privacy Policy. You can delete Your Content, your organization, or your account at any time.
6. Third-party services#
The Service relies on third parties — including Stripe (payments), OpenAI (to generate explanations of engine findings), and our hosting and email providers. Their handling of data is covered in the Privacy Policy. Your use of any connected service (e.g. a GitHub or GitLab repository) is also subject to that provider's terms.
7. Disclaimers#
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that findings are complete or error-free, that the Service will be uninterrupted, or that acting on a recommendation will produce a particular performance result.
8. Limitation of liability#
To the maximum extent permitted by law, Harpoon will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
9. Termination#
You may stop using the Service and delete your organization or account at any time. We may suspend or terminate access if you breach these terms or use the Service in a way that risks harm to others or to the Service. On termination, the rights granted to you end and your data is deleted per the Privacy Policy.
10. Changes to these terms#
We may update these terms; when we make material changes we'll update the date above and, where appropriate, notify you. Continuing to use the Service after a change means you accept the updated terms.
